Poorly Trained Truck Drivers Causing Accidents
Trucking companies are required to hire qualified drivers. This means that drivers should have a commercial driver’s license (CDL), plus training and certification for the type of vehicle they are driving. If you or a loved one has been injured by a driver who did not receive proper training or certification, the trucking company may be liable.
In the aftermath of a serious truck accident, our lawyers will conduct an investigation of the driver’s background and other safety issues. In some cases, we find that the trucking company was negligent in training or screening its drivers. Examples include hiring a driver with multiple traffic violations, hiring a driver who is not certified or trained for the type of truck he or she is driving, failure to conduct drug and alcohol tests on the driver & hiring a driver with a history of accidents.
The trucking industry is highly regulated by the Federal Motor Carrier Safety Administration and state agencies. These regulations include required truck driver training and certification. When trucking companies violate FMCSA rules and regulations, they may have to pay punitive damages in addition to other losses.
